1. Agreement to these Terms

These Terms and Conditions (“Terms”) form a binding agreement between you and Design & Desktop, LLC (“we”, “us”), a Delaware limited liability company based in the United States, operating Plota at https://plota.app.

We offer the Service online to customers worldwide. By accessing the website or purchasing an eSIM plan, you agree to these Terms and our Privacy Policy and Cookie Policy. If you do not agree, do not use the Service.

2. The Service

Plota is an online marketplace for travel eSIM data plans sold from the United States to customers around the world. After a successful purchase, we provide installation instructions and a QR code (or equivalent) so you can install the eSIM on a compatible device.

Mobile network coverage, speed, and availability depend on third-party networks and our wholesale suppliers. The Service is provided subject to supplier availability and their network terms. Some destinations or payment methods may be unavailable due to sanctions, supplier limits, or legal restrictions.

3. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for accurate account information and for keeping login credentials confidential. You are responsible for activity under your account.

4. Orders, pricing, and Stripe payments

Displayed prices include applicable taxes where stated at checkout; otherwise taxes may be added where required. Prices may change for future orders.

Payment is processed by Stripe. By paying, you authorise Stripe and us to charge the selected payment method for the order total. Orders are confirmed when payment succeeds and we accept the order.

We may refuse or cancel an order (and refund you) in case of suspected fraud, pricing errors, stock/supplier unavailability, or legal restrictions.

5. Delivery of digital content

eSIMs are digital content. Delivery typically occurs immediately after successful payment by making installation details available in your account and/or by email.

You are responsible for checking device eSIM compatibility before purchase and for correctly installing the eSIM.

6. Right of withdrawal (where local consumer law applies)

Because we sell online from the US to customers worldwide, your rights depend on where you live. If you are a consumer in the EEA or UK, you normally have a 14-day right to withdraw from distance contracts under local consumer law.

For digital content not supplied on a tangible medium, that right is lost once performance begins if you: (a) gave prior express consent to begin performance during the withdrawal period; and (b) acknowledged that you thereby lose the right of withdrawal.

By completing checkout and receiving immediate access to your eSIM, you request immediate supply and acknowledge that you lose the right of withdrawal once the eSIM credentials/QR are made available to you, to the extent permitted by law.

Nothing in these Terms limits mandatory consumer rights that cannot be waived under the law of your country of residence (including remedies for lack of conformity of digital content where such rules apply).

7. Refunds and cancellations

Because eSIMs can be used immediately after delivery, refunds are generally not available once credentials/QR codes have been delivered, except where required by law or in the cases below.

We may offer a refund or replacement at our discretion (or where legally required) for: confirmed technical provisioning failure on our side; duplicate charges; or inability to deliver the purchased plan due to supplier failure.

Network coverage issues caused by local operators, incompatible devices, incorrect installation, or consumption of data are not normally refundable.

Refunds, when approved, are processed via Stripe to the original payment method within a reasonable period.

8. Acceptable use

You agree not to:

  • Use the Service unlawfully or in violation of export/sanctions rules.
  • Attempt unauthorised access, disrupt, or reverse engineer the Service.
  • Resell or redistribute eSIMs in breach of these Terms or supplier rules.
  • Abuse fair-use, spam, or fraudulent payment methods.

9. Intellectual property

The website, branding, and content are owned by Design & Desktop, LLC or its licensors. You receive a limited, non-exclusive right to use the Service for personal, non-commercial purposes unless otherwise agreed in writing.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”. We do not guarantee uninterrupted coverage, specific speeds, or fitness for a particular purpose. Coverage depends on third-party networks.

Mandatory consumer guarantees under EEA/UK law remain unaffected.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business opportunities.

Our aggregate liability arising out of or related to the Service is limited to the amount you paid us for the order giving rise to the claim in the 12 months before the claim.

These limits do not exclude or limit liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under applicable law. For EEA/UK consumers, nothing excludes liability for breach of mandatory consumer rights.

12. Governing law and disputes

As a US company selling online worldwide, these Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. If you are a consumer in a country with mandatory consumer protections (including the EEA or UK), you also retain the protection of those mandatory provisions of the law of your country of residence.

Courts of Delaware have jurisdiction, without prejudice to any mandatory right you may have as a consumer to bring proceedings in the courts of your place of residence.

13. Changes

We may update these Terms by posting a new version on this page. Continued use after the effective date constitutes acceptance, except where mandatory law requires a different process for material changes affecting consumers.
